Privacy Policy

  1. PURPOSE OF OUR POLICY

    1. This Policy pertains to the manner in which Dhukuti International Group Pty Ltd (ACN 625 086 955) and its related bodies corporate (referred to herein as "we," "us," or "our") manage "personal information" as defined in the Privacy Act 1988 (Privacy Act) and other customer data, including the processing of any messages, files, or other content submitted through services we offer (collectively referred to as "Customer Information").
    2. The adoption of this Policy is aimed at ensuring the establishment of standards to safeguard the Customer Information collected about individuals, which is deemed necessary and incidental to:
      • providing the system and services offered by us;
      • the operation of our website; and
      • the routine operations of our business.
    3. Compliance with the Australian Privacy Principles outlined by the Australian Government for handling personal information under the Privacy Act is assured by us.
  2. WHO AND WHAT THIS POLICY APPLIES TO

    1. Customer Information is collected by us on our behalf and in relation to organizations utilizing services provided by us.
    2. This Policy is applicable to all forms of information, whether physical or digital, collected or stored electronically or in hardcopy.
    3. Should an individual provide Customer Information or other information regarding someone other than themselves at any time, the individual warrants that they possess the consent of such person to provide said information for the specified purpose.
  3. THE INFORMATION WE COLLECT AND RECEIVE

    1. In the course of business transactions, it is imperative for us to collect Customer Information to identify individuals utilizing our products or services, share Customer Information upon request, contact individuals in the normal course of business, and transact with individuals. The types of information we may collect include, but are not limited to:
      • Customer Information: To access our services, we may need to collect Customer Information, including first name, last name, email address, and phone number;
      • Contact Information: Information such as email address, telephone or fax number, third-party usernames, residential, business, and postal addresses enabling contact with individuals;
      • Other Information: This may include user names, user roles within an organization, user dates of birth, and user account login details;
      • Statistical Information: Records and logs of information such as volume of accounts used, duration and frequency of use, data level and bandwidth usage, type of device and browser used, and internet provider details;
      • Training Data: Information and data in the form of training materials and content;
      • Information Sent to Us: Personal correspondence sent by individuals.
    2. Other Customer Information about an individual may also be collected, which shall be maintained in accordance with this Policy.
    3. "Sensitive information" as defined in the Privacy Act (Sensitive Information), such as information concerning health or health treatment, is not collected by us.
    4. Information regarding an individual's location at the time of access may also be collected, including through the use of Application Programming Interfaces (APIs) or by reference to their IP Address.
  4. HOW INFORMATION IS COLLECTED

    1. Information is predominantly collected in association with an individual's use of our services, inquiry about our services, use of our website, or general dealings with us. However, Customer Information may also be received from sources such as staff, recruitment agencies, and business partners. The collection of information typically occurs through:
      • Registrations/Subscriptions: Individuals providing Customer Information details to register or subscribe for a service;
      • Supply: Individuals supplying goods or services to us;
      • Contact: Individuals contacting us in any manner;
      • Access: Individuals accessing us through the internet, where information may be collected using cookies, APIs, or analytical services; and/or
      • Use: Individuals using the services we provide
    2. Efforts will be made to ensure individuals are always aware of when their Customer Information is being collected, given the various circumstances under which information may be collected.
    3. In instances where Customer Information is obtained without an individual's knowledge (e.g., accidental acquisition from a client), either the information will be deleted/destroyed, or the individual will be informed of our possession of such information, in accordance with the Australian Privacy Principles
  5. WHEN CUSTOMER INFORMATION IS USED AND DISCLOSED

    1. The primary principle dictates that Customer Information shall not be used for purposes other than those for which it was collected, except with the individual's permission. The purpose of collection is determined by the circumstances under which the information was collected and/or submitted.
    2. Customer Information shall be retained for the duration necessary to fulfill the purposes outlined in this Policy, unless a longer retention period is mandated or permitted by law.
    3. Customer Information, such as training data and results, may be disclosed to a user's account administrator or other delegated users as determined by such account administrator.
    4. Disclosure of Customer Information to affiliated companies, government agencies, and other third parties shall be conducted in accordance with this policy and the Australian Privacy Principles.
    5. Under no circumstances shall an individual's Customer Information be disclosed or sold to unrelated third parties.
    6. Information is utilized to facilitate the operation of our business, particularly concerning individuals, which may include:
      • Providing access to our services;
      • Improving the quality of our services;
      • Verifying an individual's identity;
      • Communicating with individuals regarding their relationship with us, our marketing and promotions, surveys, questionnaires, etc.;
      • Investigating complaints or suspected unlawful activity; and/or
      • Complying with applicable laws (including the Privacy Act).
    7. Circumstances may necessitate the disclosure of an individual's information, including:
      • Reasonable belief of an individual's engagement in fraudulent, deceptive, or unlawful activity warranting notification to a governmental authority; and
      • Legal requirements (including the Privacy Act).
  6. DATA RETENTION

    1. Customer Information shall be retained in accordance with any applicable terms in the Software as a Service Agreement and customer usage functionalities, and as mandated by applicable law. Information pertaining to an individual's use of our services may be retained for as long as necessary for the purposes described in this Policy, including post-deactivation of an account for legitimate business interests, audits, legal compliance, dispute resolution, and enforcement of agreements.
    2. Requests for deletion of Customer Information from our services may be initiated by a customer through written request to the Privacy Officer.
    3. Individuals who have provided or had personal data provided to us, but do not possess an Infinity Reality account, may initiate a written request for deletion by contacting the Privacy Officer.
  7. CHOOSING TO BE CONTACTED

    1. Individuals may choose not to have their personal information collected, which may result in the unavailability of some or all of our services and termination of access to some or all of the services accessed with or through us. This choice is evident when:
      • Opting In: Individuals have the option to choose to have information collected and/or receive information from us where relevant; or
      • Opting Out: Individuals have the option to exclude themselves from some or all information collection and/or receiving information from us where relevant.
    2. If an individual believes they have received information from us without opting in or after opting out, they should contact us using the details provided below.
  8. SECURING YOUR CUSTOMER INFORMATION

    1. A Privacy Officer may be appointed to oversee the management of this Policy and ensure compliance with the Australian Privacy Principles and the Privacy Act. This officer may have additional duties within our business and may be assisted by internal and external professionals and advisors.
    2. Personal information of individuals shall not be disclosed to entities outside of Australia lacking a similar regime to the Australian Privacy Principles or an enforceable Policy similar to this Policy. Reasonable steps shall be taken to ensure that disclosure to entities outside of Australia occurs only after written agreement to safeguard personal information as we do.
    3. All reasonable precautions shall be taken to protect an individual's personal information from unauthorized access, including securing physical facilities and electronic networks.
    4. Encryption is utilized for storing and transferring Customer Information. However, the security of online transactions and communications cannot be guaranteed. Individuals providing information via the internet or by post do so at their own risk, and we cannot accept responsibility for misuse, loss, or unauthorized access to Customer Information beyond our control.
    5. We bear no responsibility for the privacy or security practices of any third party, including those to whom we are permitted to disclose an individual's Customer Information under this policy or applicable laws. The collection and use of an individual's information by such third parties may be governed by separate privacy and security policies.
    6. Individuals suspecting any misuse, loss, or unauthorized access to their Customer Information should notify us immediately.
    7. We shall not be liable for any loss, damage, or claim arising from another person's use of Customer Information where we were authorized to provide said information to that person.
  9. HOW TO ACCESS AND/OR UPDATE INFORMATION

    1. Subject to the Australian Privacy Principles, individuals possess the right to request from us the personal information we hold about them, and we are obligated to provide such information within 28 days of receiving their written request.
    2. If individuals are unable to update their own information, we shall correct any errors in the personal information we hold about them within seven days of receiving written notice of those errors.
    3. Individuals are responsible for providing accurate and truthful personal information. We cannot be held liable for incorrect information provided to us.
    4. Reasonable fees may be charged to individuals for costs incurred in meeting any requests to disclose Customer Information we hold about them.
  10. COMPLAINTS AND DISPUTES

    1. Individuals with complaints regarding our handling of their Customer Information should address their complaint in writing to the details provided below.
    2. In case of disputes concerning Customer Information, both parties must first attempt to resolve the issue directly.
    3. Upon becoming aware of any unauthorized access to Customer Information, we shall inform the affected individuals at the earliest practical opportunity once the accessed information and means of access are determined.

    1. Important notices, such as changes to our terms, conditions, and policies, may be sent to individuals from time to time. Given the importance of this information to an individual's interaction with us, opting out of receiving these communications is not possible.
